Technical Regulation on Construction Products

While the certification of construction materials in Ukraine remained a voluntary procedure for a long time, today the rules of the game have fundamentally changed. Since January 1, 2026, conformity assessment according to the new European standards has become a strictly mandatory step for placing any construction product on the national market. Ukraine has fully transitioned to the European regulatory model (implementation of Regulation (EU) No 305/2011/CPR) in accordance with the Law of Ukraine "On Making Construction Products Available on the Market".
Henceforth, every manufacturer or importer is required to draw up a Declaration of Performance for a construction product, affix the national conformity mark, and register the documents in the state system. The sale and use of products on construction sites without undergoing this procedure are illegal.SYSTEMS OF ASSESSMENT (AVCP) AND THEIR IMPACT ON THE CERTIFICATION PROCESS
Depending on the intended use of the construction product and its impact on the safety of structures, the legislation defines 5 systems of Assessment and Verification of Constancy of Performance. They clearly distinguish which steps are performed by the manufacturer itself and where a Certification Body must be involved:
Systems 1+ and 1 (Maximum Control): Applied to critical structures (e.g., cement, rebar, fire doors). The involvement of a Certification Body is mandatory. The Body personally conducts testing of product samples, performs the initial audit of the plant, and subsequently carries out regular surveillance of the Factory Production Control (FPC). The Body issues a Certificate of Constancy of Performance.
System 2+ (Production Control): A widespread system for many general construction materials. The manufacturer tests the products independently, but the Certification Body must conduct an audit and continuous surveillance of the Factory Production Control (FPC). The Body issues a Certificate of Conformity of the Factory Production Control.
System 3 (Laboratory Tests Only): The manufacturer maintains production control independently, but product testing must be conducted exclusively by an accredited testing laboratory (notified/designated body). No certificate is issued.
System 4 (Complete Autonomy of the Manufacturer): The Certification Body is NOT involved. The manufacturer independently conducts product testing, implements Factory Production Control (FPC), and draws up the Declaration of Performance based on its own data. The certification process for construction products in Ukraine includes the following stages (depending on the assessment system):- Product identification: Determining the essential characteristics and the corresponding national standard (DSTU EN or designated technical specifications).
- Testing of samples: Conducting laboratory tests for strength, fire resistance, environmental friendliness, etc.
- Audit of Factory Production Control (FPC): Assessment and certification of factory production control.
- Drawing up the Declaration of Performance: Drafting the official document where the manufacturer assumes responsibility for the conformity of the product with the declared parameters.
- Registration in the EGESSB: A mandatory stage for placing construction products on the market. The Declaration of Performance of a construction product must be registered without exception in the Unified State Electronic System in the Field of Construction (e-construction) using a Qualified Electronic Signature (QES). Without this registration, the product is considered illegal for use on construction sites.
